The team provides qualified, professional legal advice, representation and training on all aspects of school business. This includes access to a dedicated team of experienced lawyers, a named contact officer, specialist education law knowledge and advice and a flexible, approachable service.
The service is designed for Headteachers, Governors, School Business Managers and Bursars. It is available for local authority maintained secondary, primary, nursery and special schools. A service for academies and free schools can be arranged on request.
Costs for Employment Law advice are met through the Human Resources Advice and Guidance SLA for those schools that purchase that service. This covers representation at Employment Tribunal hearings up to a maximum of two days.
All other areas of legal advice are offered as a ‘buy-back’ service. Legal Services offer up to two hours of legal advice per matter in relation to all areas of school business. Schools are therefore able to raise legal queries on a range of issues as they arise during the year. This service is provided for a fixed rate of £433.50 per annum for primary, nursery and special schools and £969 per annum for secondary schools.
Where a matter becomes more complex and reaches the two hour limit for advice on a particular issue, a quotation can be provided on a discounted hourly or fixed rate basis. The discounted hourly rates applicable to schools that have purchased the SLA are:
- Legal Assistant - £45 per hour
- Lawyer - £70 per hour
- Senior Lawyer or above - £80 per hour
Schools are able to seek legal advice on any area of school related business. If the school is not part of the ‘buy-back’ arrangements set out above, the two hour per matter free advice and the discounted rates above will not be available. However, a quotation can be given on request on an hourly rate or fixed fee basis. This would be at commercial rates and subject to capacity.
